You know the Kashi commercials where they say that the stuff contains no cardboard? That may well be true.
However, what it does seem to contain is very, very stale SugarSmacks and apparently gravel.

... Currently playing with my new PC speaker system.

I would have said simply "speakers", but everything seems to be a "system" these days and it sounds much more pretentious.

The missus will be happy to know that I also got a new stereo headset that plugs into one of the USB ports located on the front of the pc tower (system), so she can play her goofy games while I growl at the stupid people on tv and we shant disturb eachother in the process.

Christ I have a lot of 80's metal MP3s ...

Trinity (the girlcat) can tell when it's going to rain.

She will stop whatever badness she is currently engaged in and stare at the window and start to growl (actual growling) like: "Rrrrrrrrrwwwwwwwwlllll", she will then run behind the couch to hide.

Sixty seconds later it starts raining.

... It's been a crap few weeks.

Another 4-5 months until I can schedule back surgery. (Unless they can manage to find yet another wrench to throw into the works).

lamia_prime's grandmother passed away yesterday. I liked her, she was a cool lady. She never smoked a day in her life and she died of lung cancer ... That just dosen't seem right to me.

My father continues to be a blockhead. He finally made an appointment with the doc after not telling anyone that he has had tightness in his chest and was easily tired FOR TWO WEEKS. The result being surgery to stint a vein that was mostly blocked near his heart and was as thin as a hair. (Mom was a bit sketchy on the details). But he gets released tomorrow. (Wed. the 16th.) And I will have to remember to go and give him a smack upside the head.

Both my mother and my wife say "That the apple dosen't fall far from the tree". Yet I really don't think that I am as stubborn and self-righteous as the old man.

What do you think?

Yeah I know It's been awhile since I posted anything in here, I really haven't had anything to report.

However, I got the word yesterday that the URO review that the wretched insurance company demanded has decided that disc replacement surgery IS necessary and reasonable treatment in my case. YAY!
My mouthpiece has advised me to hold off on scheduling the surgery until he can check to see if there is any other way in which they can attempt to once again weasel out of paying for it.
Since the insurance company asked for the URO review in the first place he doesn't think that they can appeal the decision but he wants to check it out to be sure and I really really don't want to have the surgery and be stuck with the bill.
What does all this mean you ask?
Well in as little as a few days from now, but NOT longer than 30 days I can call my surgeon and schedule the disc replacement surgery. Period.
Depending upon how long it takes to get the surgery scheduled I could be fixed up and ready to rock by early fall. I'm thinking two months tops till I go under the knife.

So yeah, I'm pretty happy atm.

I got a letter the other day from the wretched workmans comp. insurance company's law office. It stated that I have an appointment with an independent physician to be examined so that a decision can be made as to the approval for the disc replacement surgery.

The appointment is on March 23rd. in Harrisburg *grumble* and I will be inquiring, pointedly, as to how long it will take for the MD/panel to reach a decision and hopefully I won't have to wait another 5-6 months for an answer. I will also be telling them to send me a letter when a decision is reached since the enemy law office cant be bothered to keep me or my lawyer in the loop.

Even though an examination is pretty pointless and all the MD really needs to do is look at my medical records and MRI films/reports or speak with my surgeon I am still fairly pleased that at least things are finally moving forward.
This is (I have been assured) the last retarded hoop that I will have to jump through in order to get my back fixed and I will not have to deal with the workmans comp. morons ever again with the exception of depositing the pittance that they are paying me for disability.

I have a meeting with my mouthpiece on Monday afternoon where among other things I will get some info on what all I can expect at the examination as well as getting him to send ANOTHER petition to the judge to get the damned insurance company to pay the last 4 remaining medical bills that have now gone into collection and wrecked my credit report. *mutter mutter*

Protecting Copyrights or Stifling Competition?

It's hard to find a digital music industry executive or Internet radio broadcasting service provider who would agree with the above statement of the bill's intent, however.

If the Perform Act were to pass in its current form, said the Electronic Frontier Foundation's Activism Coordinator Daniel O'Brien, "the winners, at least briefly, would be the record industry, which would temporarily be able to freeze in law their current ideal market position -- able to dictate terms to both the broadcasters and the technologists."

The implications of the bill and the precedent it could set are just as ominous, if not moreso, according to O'Brien.

"For everyone else, we'll get government-mandated technology decisions in radio and on the Web. We'll get cheap, open source innovation locked out of media devices," he predicted. "We'll see consumers hamstrung in their ability to do what they can do with lawfully acquired content in their own homes. It's not just about slowing the pace of improving media and technology in the consumer market -- it would turn it back."

In addition, O'Brien added, the bill proposes restrictions that would have banned new services such as TiVo, had they been applied to digital video.

"In the end, the RIAA and its members would lose as much as anyone else. Tying the hands of satellite radio and Internet audio isn't going to expand the market for musicians or their management," he said.

A Death Knell for MP3?

A section of the bill aimed at ensuring copyright and payment rights protection to musicians and recording companies by establishing what is now a proprietary DRM format as a standard may also deal a staggering, if not a knockout, blow to the MP3 format.

Used around the world by webcasters large and small, from individual hobbyists to industry giants such as Apple's iTunes and iPod services, MP3 has grown from the grassroots up to emerge as a de facto digital music standard.

If passed in its present form, the bill would also set what many consider an intrusive and unhealthy legislative precedent by establishing a preferential technological standard by government fiat, as opposed to allowing a standard to emerge through regulated market competition.

"It's my understanding that the only one [DRM format] out there that does what the language of the bill requires would be Windows Media DRM. So, yes, this provision could be considered a mandate of a Microsoft technology," said Robert Schwartz of the Home Recording Rights Coalition.

Asked whether this might be a death knell for the widespread, large-scale use of streaming MP3 as a format, Schwartz said, "It would be indeed."
